Yeah it was a time of close decisions between wrestleboxers. Mike Pierce actually had close decisions with both and could have gotten the nod in either.
Kos def. fell off a cliff after the GSP rematch. The broken orbital was severe and it affected his mindset for his following fights. He'd wipe at the same eye after even a glancing shot to it and then get gunshy and become a defensive shell until he'd get beatdown.
Koscheck was an ass but he stayed afloat through a couple eras at WW and was still competitive with the up and comers until his last slid. For that I give him props.

I would say more often than not it isn't done with malicious intent but he has caused harm. MMA has a high bar for actual bad people imo.

Depends. If the superfight hadn't been named then both DC and Stipe could have defended by the time 226 came considering they did a TUF season for it. Both doing at least 150k if they each headlined their own card.
