Judge rules Trump can't claim 'logistical burdens' if he decides not to attend upcoming trial in NYC

If former President Donald Trump opts not to attend his trial next week in which he stands accused of defaming and battering writer E. Jean Carroll, a federal judge ruled Thursday that his lawyer can make no mention of the "burdens" that might spare New York City.

Trump attorney Joe Tacopina had asked the judge on Wednesday to inform the jury that if Trump didn't appear for the trail in lower Manhattan, it would be to avoid the "logistical and financial burdens upon New York City, its residents, and court itself."

Judge Lewis Kaplan, who is presiding over Carroll's lawsuit against Trump, said Thursday that the decision whether to attend the trial or testify is Trump's alone, and that Trump has had "ample time" to make the necessary arrangements.

"Moreover, the Court notes from Mr. Trump's campaign web site and media reports that he announced earlier this week that he will speak at a campaign event in New Hampshire on April 27, 2023, the third day of the scheduled trial in this case," Kaplan said in his ruling. "If the Secret Service can protect him at that event, certainly the Secret Service, the Marshals Service, and the City of New York can see to his security in this very secure federal courthouse."

Kaplan said it was premature to tell the jury anything about Trump's presence or absence.

"Should he elect not to appear or testify, his counsel may renew the request," Kaplan said. "In the meantime, there shall be no reference by counsel for Mr. Trump in the presence of the jury panel or the trial jury to Mr. Trump's alleged desire to testify or to the burdens that any absence on his part allegedly might spare, or might have spared, the Court of the city of New York."

In her lawsuit, brought in November, Carroll alleges that Trump defamed her by calling her a liar when he denied her claim that he raped her in a department store dressing room in the 1990s. She added a charge of battery under a recently adopted New York law that allows adult survivors of sexual abuse to sue their alleged attacker regardless of the statute of limitations.

A judge last week denied Trump's attempt to delay the start of the trial, which is scheduled to get underway in New York on Tuesday.

Trump has repeatedly denied Carroll's allegations.

An attorney for Carroll chided Tacopina's request on Wednesday, writing in a separate letter that "the notion that Mr. Trump would not appear as some sort of favor to the City of New York -- and that the jury should be instructed as much -- taxes the credulity of the credulous."


The judge had given Trump until the end of the day Thursday to let the court know for sure whether he'd attend the trial, but Tacopina said in a letter to the court Thursday afternoon that Trump would make that decision while the trial is in progress.

"Because the decision of the defendant, who is not required to appear as a civil litigant, will be made during the course of the trial. we are not yet in a position to advise the Court in this regard," Tacopina said. "However, we will inform the Court as soon as a decision is reached, particularly in light of the logistical concerns that will need to be addressed in coordination with the Secret Service, the Marshals Service, and the City of New York."

"Your consideration in this matter is greatly appreciated," Tacopina said in the letter.

so the one-pump chump doesnt want to purjure himself on the stand, and Mr. "Only Guilty People Plead The Fifth" is trying everything to avoid having to testify at his own rape trial. he failed to stall his own trial and his court date is looming. His genius idea now? Just not show up to his own trial!

unfortunately for him, this is a civil trial, not a criminal trial, so by not taking the stand and testifying in his own defense, the jurors can and will use it against him when it comes to reaching their verdict

well, his lawyers plan was to just get him to not show up, but be able to tell the jurors that he really wanted to be there and testify, and there's nothing more he would rather do than to show up at his rape trial and take the stand, but he was far too busy with other obligations to be able to show up to court, all in hopes that they wouldnt take trump's no-show into consideration.

it's all Mr. "Only Guilty People Plead The Fifth" simply just trying to play games with the court

an innocent man would be glad to show up to trial and go up there and clear his name and defend his honor, lay it all out there for how it really is, and put all of the accusations against him to bed.

not trump though. the moment he opens his mouth he will end up purjuring himself during cross examination. I guess If you plead the fifth - you're guilty, unless you're donald trump of course. because everythings all a big witch hunt or whatever. only donald trump, and people who are guilty refuse to take the stand and testify i guess.

all of these years of belittling people as criminals for taking the fifth and this motherfucker pled the fifth over 400 times in august last year at just one deposition. he had to sit for deposition again last week and he probably even smashed that record right out of the park. and of course he's never going to testify during his criminal indictment trial, and he's now trying to weasel his way out of testifying at his rape trial too.

its everybody else who is guilty that pleads the fifth. just not donald trump, because reasons unbeknownst to man. he has no problem talking about these cases everywhere outside of a courtroom where he can lie through his teeth to make himself look like the innocent victim and never be held accountable for his own lies, but those kind of antics do not slide in a courtroom environment and he knows that.

he won't say a peep about any of it in court, and if he does, it won't line up with whatever he was saying on social media and outside of a courtroom in his defense. and then after he loses in trial, he'll go back on social media and blame his lawyers or whatever - "Don't believe what i was saying while i was under oath! Thats really not what happened at all! My Deep State swamp donkey lawyers made me take the stand and lie! None of that was true!"

Judge restricts Trump’s social media posting in hush-money case: report

The New York state court judge overseeing the hush-money case involving former President Trump issued a protective order restricting the former president’s social media usage Monday.

Judge Juan Merchan sided with Manhattan prosecutors with an order stating that material and information provided to the defense team for Trump is “solely for the purposes of preparing a defense in this matter,” NBC News reported.

Trump faces 34 felony counts of falsifying business records over his alleged role in a hush money payments made to adult film star Stormy Daniels to cover up an alleged affair ahead of the 2016 presidential election. He pleaded not guilty.

NBC News also reported that the order said that anyone with access to the evidence handed over to Trump’s team “shall not copy, disseminate or disclose” the material, including on social media, without getting approval by the court.

The order reportedly said that Trump can view some sensitive information only in the presence of his lawyers, and “shall not be permitted to copy, photograph, transcribe, or otherwise independently possess the Limited Dissemination Materials.”

NBC News reported last month that the prosecutors asked Merchan to limit what evidence Trump can publicly use in the investigation, requesting “safeguards that will protect the integrity of the materials.”

The Hill has reached out to Trump’s legal team and the Manhattan District Attorney’s office for comment.
