Two of the security guards in the video are black. Are they racist?

The news broadcast explains @0:45 that there have been various incidents of mischief, violence and shootings over the last few years. I wonder why the mall is taking extra precautions?

The race of the security guards isn't relevant. It is the INTENT of the policy and its SELECTIVE enforcement. I would have to look it up, but I believe its Title 2 of the Civil Rights act that would cover this situation. You cant defend a claim under Title 2 by arguing "But the security guards enforcing the racist policies, are black". You would get laughed out of the court room.

The INTENT of the mall's policy is to reduce the mischief, violence and shootings that have been on the rise over the last few years. I doubt white, middle-aged soccer mom's are the guilty culprits involved in the violence and shootings which is why they are not being targeted.

But the reality is this.... We live in a country of laws. If a business wishes to serve the public they have to abide by those laws. Title II of the Civil Rights Act of 1964 is one of those laws. Selective discrimination based upon race is a a prima facie violation of Title II.

Wolfchase should hire you as their lawyer. You have given some amazing defenses thus far:

If you check out the original video of the black men being removed from the mall, they were being removed by 3 security guards - 2 of whom were black. You'd basically have to make the argument that the black security guards are brainwashed pawns of the evil white patriarchy who secretly hate themselves, fat chance. Talk about much ado about nothing. I'm glad the mall picked black security guards, it shuts the activist types right up.

BS that someone in the mall was handcuffed and dragged away for wearing a hoody. I don't believe that for a second.
He was arrested because he was asked to leave. He left the property, then came back. He wasn't arrested for wearing a hoodie.

Soon after, the security guard then pulled out his radio to call in reinforcements, leading to the immediate arrival of a police officer who then escorted the teenagers out of the mall. When Kevin then attempted to intervene, he was informed that the teenagers had violated the mall’s dress code by wearing—you guessed it—hoodies. Which coincidentally, the Wolfchase Galleria’s “code of conduct” makes no mention of.

After leaving, the teens then returned to the mall entrance, with one contesting that “we have rights.” At that point, about four law-enforcement officials confronted the teenagers before they could reenter the shopping center and threatened to arrest them for “criminally trespassing on private property”. It was at that point that one of the teens was then handcuffed.

And, also, we have "no shoes, no shirt, no service" policies in place and have forever. I don't see how this is any different.

This really has nothing to do with this thread at all. The discussion has nothing to do with general dress codes.

This thread's primary debate comes down to one question. Is it okay for a business to create a rule that only applies to one race? The legal answer is obviously that it's illegal. We are not even discussing whether or not the experiment was sound, or whether this particular mall actually has a problem. We are talking about a generality. Is it okay for a business to create a rule only for one race.

Ski mask is kind of a stretch lol but having a hoodie up I can see how it would arouse suspicion in a retail store regardless of race.

However, if there hoodies are down I do not understand the mall's argument. The mall probably sells hoodies in their stores, so what sense does it make to ban them in their dress code? They're establishing a stereotype it seems.

That's the point of the video.. The policy is only being selectively enforced.
 
Nice of them to wear form fitting hoodies that don't allow items to be concealed underneath. Instead of 3x hoodies that could smuggle a Ford Focus through airport security.
 
having worked retail, i can tell you that most theft at malls are absolutely from white women.
