Thar literally means they are breaking the law. Just as you don't go to jal for disturbing the peace, everyone acknowledges that you broke the law.

That you don't suffer the same consequences for breaking different laws is the point. Just because two crimes have one penalty in common doesn't mean the perpetrators are viewed, treated, and penalized in all the same ways.
