Any human under US jurisdiction has the same rights in court, illegal or otherwise.

He has a right to bail just like anyone else who is accused of a crime. The failure here isn't the law, but the local authorities that didn't communicate his status properly.

This is a case of someone who has already allegedly committed a horrific crime escaping justice because of a failure of bureaucracy.

He was granted bail on the condition his passport would be surrendered.. he can't flee without a passport.

They failed to collect his passport and they failed to notify the local border agents that he was free.
