This is most likely going to be the case. But with all the media on this, they might want to throw the book at this guy like they did to war machine, but the difference here is the wife is most likely not going to press charges and that's going to make it difficult for the prosecution.
Thing is, sadly i wouldn't blame the wife, how is she going to explain to her kid that the reason her dad is serving life in prison is because she put him there.

What I mean is that people read "attempted murder" without understanding that he was arrested on "suspicion of second degree attempted murder" and they have no clue what classifies as second degree murder and how it's different from first degree murder or voluntary manslaughter.
